1. Acceptance and eligibility
These Terms of Service ("Terms") govern your use of samemuse.com and its AI clothes try-on tools (the "Service"). By accessing or using the Service, you agree to these Terms and our Privacy Policy.
You must be at least 13 years old. If you have not reached the age of legal majority where you live, you may use the Service only with permission from a parent or legal guardian who accepts these Terms on your behalf.
2. The Service
SameMuse creates AI-generated clothing try-on previews from person and garment images. The first Standard try-on may be available without an account. Google sign-in is required for account features, additional generations, purchases, and saved results. We may change, suspend, or discontinue features when reasonably necessary.
3. Accounts
You are responsible for activity under your account and for maintaining the security of your Google account. Information you provide must be accurate and current. Contact us promptly if you believe your account or purchases have been used without authorization.
4. Your content and permissions
You retain your rights in the images you submit and in generated results to the extent permitted by law. You grant SameMuse and its service providers a limited, non-exclusive license to host, store, reproduce, and process that content only as needed to provide, secure, and support the Service.
You must own or have all necessary rights and consent to use every image you upload, including permission from any recognizable person. Generated results do not give you rights in third-party trademarks, designs, likenesses, or other protected material.
5. Acceptable Use Policy
SameMuse is a clothing visualization tool. You may not upload, request, create, share, or use the Service for:
- Sexually oriented, pornographic, NSFW, nude, sexually explicit, fetish, or sexually suggestive content, including attempts to remove or make clothing transparent.
- Any sexualized or exploitative depiction of a minor, child sexual abuse material, or content that facilitates grooming or exploitation.
- Non-consensual intimate imagery, harassment, abuse, threats, hate, discrimination, graphic violence, or content intended to shame or harm another person.
- Face swaps, deepfakes, face manipulation, impersonation, deceptive identity use, or misleading content presented as a real person's actions or endorsement.
- Content involving a person who has not consented to the use of their image, or content that violates privacy, publicity, copyright, trademark, or other rights.
- Illegal activity; scams or fraud; counterfeit goods; or the promotion of illegal, regulated, age-restricted, or adult-oriented products or services.
- Attempts to bypass safety, usage, payment, or access controls; probe or reverse engineer the Service; distribute malware; scrape the Service; or interfere with its availability or security.
Marketing or describing use of the Service as "uncensored," "unfiltered," "no filter," "NSFW," or "18+" is also prohibited.
6. Safety enforcement
We may reject a request, remove content, limit features, suspend or terminate access, and preserve or disclose relevant records when reasonably necessary to enforce these Terms, protect users or third parties, comply with law, or maintain our payment and infrastructure providers' requirements. Serious or repeated violations may result in termination without a refund except where law requires otherwise.
7. Credits, subscriptions, and payments
Standard generations cost 10 credits and HD generations cost 20 credits. A failed or canceled generation does not consume credits. Refunds and disputes reverse associated credit grants. Monthly subscription credits reset at the start of each billing period and do not roll over. Credits from one-time credit packs do not expire. When both are available, subscription credits are used first.
Prices, billing periods, and applicable taxes are shown at checkout. Creem acts as the merchant of record and contractual seller for paid transactions and handles payment processing, invoices, and applicable sales taxes. Subscriptions renew automatically until canceled through the billing portal; cancellation takes effect at the end of the current billing period unless stated otherwise at checkout.
8. Refunds and payment disputes
Except where required by law or expressly stated at checkout, completed credit-pack purchases and used credits are non-refundable. If a generation fails before completion, its credits are not charged. Contact us with your account email and order details if you believe a charge or credit delivery is incorrect. Refunds, chargebacks, or payment disputes may remove credits or benefits granted by the affected transaction.
9. AI results and intended use
Generated images are estimates and may not represent exact garment fit, sizing, color, texture, construction, availability, or how an item will look in real life. Results may contain errors or artifacts. Confirm product details with the retailer before purchasing and do not use results for medical, safety-critical, identity-verification, or other high-stakes decisions.
10. SameMuse intellectual property
The Service, its software, interface, branding, and original content are owned by SameMuse or its licensors and are protected by applicable law. These Terms do not grant you ownership of the Service or permission to copy, resell, or create a competing service from its protected components.
11. Availability and disclaimers
The Service is provided on an "as is" and "as available" basis to the extent permitted by law. We do not guarantee uninterrupted availability, a particular result, merchantability, fitness for a particular purpose, or that every error will be corrected. Download any result you want to keep before its automatic seven-day deletion date.
12. Limitation of liability
To the maximum extent permitted by law, SameMuse and its providers will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, goodwill, or business opportunities arising from use of the Service. Nothing in these Terms excludes liability that cannot legally be excluded.
13. Suspension and termination
You may stop using the Service at any time and may cancel a subscription through the billing portal. We may suspend or terminate access for a material or repeated breach of these Terms, non-payment, fraud, security risk, legal requirement, or risk to users, providers, or the Service.
14. Changes to these Terms
We may update these Terms to reflect changes to the Service, provider requirements, or applicable law. We will post the revised Terms here and update the date above. Continued use after an update takes effect means you accept the revised Terms.
